1. Who you're contracting with

Plonk ("Plonk", "Plonk", "we", "us") is operated under the trading name Plonk. By creating an account or using Plonk, you agree to these Terms.

2. What Plonk does

Plonk is an AI-powered tool that turns your prompts, links, and uploads into shareable visual artifacts — social posts, carousels, stories, posters, decks, menus, emails, dashboards, job posts, and one-page websites — that you can preview, edit, export, and publish. The service is provided on an as-is basis, and we don't guarantee uninterrupted or error-free performance.

3. Your account

You must be of legal age in your jurisdiction. You're responsible for keeping your credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

4. Acceptable use

You will not use Plonk to:

  • break the law, infringe intellectual property, or violate third-party rights;
  • send spam, run fraud, or distribute malware;
  • probe, scrape, or interfere with the security or integrity of the service;
  • generate content that is hateful, sexually exploitative, deceptive (including deepfakes), or that promotes harm;
  • attempt to jailbreak, reverse engineer, or circumvent technical limits.

5. AI outputs

Plonk uses generative AI to produce text, images, and code. You're responsible for your prompts, for verifying the accuracy of any output, and for making sure you have the rights to any content you input. Outputs may be inaccurate and aren't a substitute for professional advice (legal, medical, financial, or otherwise). We may filter, refuse, or remove outputs and suspend accounts for repeated or serious violations of these Terms.

6. Your content

You keep ownership of content you upload or generate. You grant us a limited license to host, process, display, and back up that content solely to provide the service. If a rights holder notifies us of infringement, we may remove the content and, for repeat infringers, terminate the account.

7. Our intellectual property

Plonk, its software, branding, and documentation are owned by us. We grant you a limited, non-exclusive, non-transferable right to use the service in line with your plan. You may not resell, redistribute, or reverse engineer the service.

8. Payments, billing, taxes, and refunds

Payments are processed by Stripe, our payment processor. By making a purchase, you also agree to Stripe's Services Agreement. Prices are displayed in US dollars. Applicable taxes are calculated and collected at checkout and shown on your receipt. You are responsible for any other taxes, fees, or charges that may apply in your jurisdiction. Subscriptions renew automatically at the end of each billing period until cancelled. Refunds are handled per our Refund Policy.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. You can cancel at any time from your account page.

10. Warranty disclaimer and liability

To the fullest extent permitted by law, the service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Our aggregate liability for any claim is limited to the fees you paid us in the 6 months before the claim. We are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing here limits liability for fraud, death, or personal injury where the law does not allow it.

11. Indemnity

You agree to indemnify us against third-party claims arising from your content, your use of the service in violation of these Terms, or your violation of applicable law.

12. Changes

We may update these Terms. Material changes will be communicated by email or in-app notice.

13. Governing law

These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-laws principles.
